Never joined the regiment; article in the Indianapolis Journal, 11/15/1864, says Pate was arrested for counterfeiting on 11/13.  Another article in the 01/07/1865 issue of the Indianapolis Journal says that Pate was sentenced to two months hard labor at the Jeffersonville Penitentiary for the counterfeiting.
